Abstract:
This research aimed at 1) studying the opinions of those involved in smoking in academic institution, 2) studying legal problems of smoking control in academic institution and 3) studying guidance to ameliorate legal measure in relation to smoking in academic institution, engaging the mixed methods of documentary research and field data collection by utilizing questionnaire to target groups such as 206 people and 3 university executives. Findings of this research were students comprehend mostly about toxin contaminated in cigarettes smoke and smoking-related diseases but were aware of law on non-smokers' health protection in less to moderate level. In the same way, the university executives indicated that university personnel and students were still lack of knowledge and comprehension in the smoking control. Even though some universities announce their campus to be no smoking zone or post smoking prohibition signboard, a number of violations were definitely found. In addition, to surveillance and supervise smoking control were quite difficult under the fact that personnel taking control are inadequate and area of various campus were very broad. The rector and the deputy rector have no authority to appoint assistants of competent official under Non-Smokers' Health Protection Act B.E.2535(1992) to surveillance and supervise smoking prohibition in campus. Accordingly, a ministerial regulation should be amended to have university proclaimed to be no smoking zone, to authorize the rector and the deputy rector to appoint assistants of competent official for relevant duties and to authorize the rector to issue identification card of assistants of competent official in order to provide effective law enforcement. Moreover, various universities should seek for cooperation and encourage lecturers, officials and employees to help advocate, promote and create mind of smoking prohibition as well as stipulate definitely and objectively penalty to any violator.
